Definitive permanence in Quality as a married person (a) with National

Legal fundaments: Article 14, 25 and 35 of the Decree Law #16 of 30th of June of 1960, Law #13 of 20 of September of 1965 6ta of 5 of 1980 Executive Decree and the Law, the Decree March #52 of 19th of February of 2003.

Approximated time of process: 2 to 4 months.

Candidates:
Those people to those who the permission of provisional residence granted with Visa is overcome to them as a married person as a immigrant married with a national.

In case the request includes dependants, the requirements of Definitive Permanence in Quality of Employee of Resident will have to be enclosed, proving the kinship bond and that the resident account with the established sufficient economic solution in the Executive Decree #52 of 19th of February of 2003. (Minimum Entrance of USD$500.00 monthly more USD$75.00 by each employee). It must consider that the foreigner who is including as a employee of a resident, will Not be able to obtain work permission.

DEFINITIVE PERMANENCE

Requirements:

  • Transaction Membership card.
  • Medical certificate of Good Health sent within the three (3) months previous to the date of presentation. (It must have date, company’s signature and stamp with the name, code and record number of the doctor).
  • Power of attorney at law and Request.
    • Power:
      • Complete Information of the person interested:
        • Name,
        • Nationality,
        • Exact address,
        • Name and Nationality of the parents,
        • Telephone numbers,
        • Email address.
      • General Information of the Lawyer
        • Office’s Address,
        • Fax and Telephone numbers,
        • Email address.
      • Tax stamp of value of USD$4.00 by page.
      • The Power will have to personally appear before the civil employee of the National Office of Migration and Naturalization or with the note of Personal Presentation before a Public Notary.
    • Request:
      • Complete and general information of the principal.
      • Complete and general information of the empowered.
      • Complete and general information of the checks that are contributed:
        • Number of the Check,
        • Name of the Bank,
        • Date,
        • Amount.
      • List and identify the documents that are enclosed.
      • Expose the foundations in fact and of right. 
      • Tax stamp of value of USD$4.00 by page.
  • Passport of the country of origin with a minimum validity of six (6) months.
  • Photocopy of the passport.
  • Two (2) photos membership card size.
  • Marriage certificate sent by the Civil Registry within the 6 months previous to the date of presentation of the document, and must count on the respective fiscal tax stamp. If the Marriage were celebrated abroad it must be properly enrolled in the Civil Registry of Panama.
  • Present Personal Identity card of the spouse or the Panamanian spouse, authenticated by the Civil Registry.
  • Letter of responsibility of the spouse or the Panamanian spouse, signed, where it is committed to cover all the expenses of the foreigner and repatriation if it were necessary.
  • For the man, resolution sent by the Ministry of Labor and Social Development, where authorizes the foreigner to work as a married person in the national territory with National citizen. In case of not having it to the date of presentation of the Request of the Permission of Residence in Migration, it can present a certification sent by the Ministry of Labor and Social Development, where it indicates that this Permission is in process or it can present simple copy of the Power and Request by means of Lawyer directed to the Ministry of Labor and Social Development. In this case, slope has left the presentation of the respective Permission of Work. If the Permission of Work is denied by the Ministry of Labor and Social Development or it is not presented to the National Office of Migration in the counted term of three months as of the date of presentation of the Request of the Permission of Residence, this it will be denied.
