Legal fundaments: Articles 14, 25 and 35 of the Decree Law #16 of 30th of June of 1960, the Decree Law #13 of 20 of September of 1965, the Law 6ta of 5th of March of 1980 and the Executive Decree #52 of 19th of February of 2003, and Resolution 1.451 of 25 of February of 2005.
Approximated time of process: 2 to 4 months.
Candidates:
A legal person can bring to the country foreigners for those who wish to contract without exceeding the percentage that the law establishes. When the request is presented a valid process document is granted for three months and if the request is approved, then the Immigrant Visa and the Permission Residence is granted as well for a term of a year. Later, the Permanent Residence with right to Panamanian personal identification document will be able to be requested.
This Visa grants those foreigners with majority of age who does not count with their own rents and are hired by legal people, perceiving an entrance that in opinion of the National Management of Migration and Naturalization is sufficient to cover their expenses in the national territory.
It is indispensable that the request is solved favorably, to contribute the Resolution sent by the Ministry of Work and Labor Development that authorizes the labor Permission and authorizes to work in the national territory within 10% of foreign personnel (the one that allows that by each ten (10) Panamanians, a foreigner can work in a company).
The National Office of Migration and Naturalization has fixed to FIVE HUNDRED DOLLAR, liquids (FREE), monthly (USD$500.00), plus SEVENTY FIVE DOLLARS, liquids (FREE), additional by each dependant (USD$75.00), the solution or minimum entrance must be approved by the foreigner.
Requirements:
- Transaction Membership card.
- Medical certificate of Good Health sent within the three (3) months previous to the date of presentation. (It must have date, company’s signature and seal with the name, code and record number of the doctor).
- Power of attorney at law.
- Power of attorney:
- The Power of Attorney must be granted the Legal Representative of the company. In the case that the foreign applicant is in Panama, the power must be signed by the Legal Representative of the contracting Company and by the foreigner.
- General information of the contracting company:
- Business name and Commercial Name,
- Location of the Main Office,
- Fax and Telephone numbers,
- Email address.
- Name and General information of the Legal or Empowered Representative if there is.
- Foreigner information who wishes to immigrate:
- Name,
- Nationality,
- Exact address,
- Name and Nationality of its parents,
- Telephone numbers,
- Email address.
- General Information of the Attorney at law
- Office Address,
- Fax and Telephone numbers,
- Email address.
- Tax stamp of value of USD$4.00 by page.
- The Power will have to personally appear before the civil employee of the National Office of Migration and Naturalization or with the note of Personal Presentation before a Public Notary.
- Request:
- To detail the objectives which the company is dedicated and wishes to bring the foreigner to the country.
- Complete and general information of the foreigner.
- Complete and general information of the checks that are contributed:
- Number of the Check,
- Name of the Bank,
- Date,
- Amount.
- List and identify the documents that are enclosed.
- Expose the foundations in fact and of right.
- Tax stamp of value of USD$4.00 by page.
- Sworn declaration about Personal Antecedents.
- Certified Check or of Management by the amount of ONE HUNDRED DOLLARS (USD$100.00) in favor of the National Treasury.
- Certified Check or of Management by the amount of FIVE HUNDRED DOLLARS (USD$500.00) in favor of the Ministry of Government and Justice, for deposit of repatriation.
- Background Record of the country of origin or the country where it has resided last the two years. If the person interested has two or more years of continuous residence in Panama he is free to present this document.
- Passport of the country of origin with a minimum validity of six months.
- Photocopy of the passport.
- Two (2) photos membership card size.
- Original Work Contract or copy authenticated by the Ministry of Labor and Social Development.
- Letter of Work in paper letterhead of the company signed by the Legal Representative in whom the paid wage for the foreigner must be mentioned.
- Copy of the Commercial License of the company.
- Resolution sent by the Ministry of Work and Social Development, where it authorizes to the person interested to work in the national territory as an employee within 10% of the personnel. In case of not having it to the date of presentation of the Request of the Permission of Residence in Migration, it can present a certification sent by the Ministry of Labor and Social Development, where it indicates that this Permission is in process or can present a simple copy of the Power and Request by means of Lawyer directed to the Ministry of Labor and Social Development. In this case, it is pending the presentation of the respective Permission of Work. If the Permission of Work is denied by Ministry of Labor and Social Development or it is not presented to the National Office of Migration in the term of three months as of the date of presentation of the Request of the Permission of Residence, this it will be denied.
- Receipt of Payment of the Request of Certification of Migratory Status that emits the National Office of Migration for use of the Ministry of Labor and Social Development.
- Photocopy of the Public Registry certification which consists who is the legal agent of the company.
